                        Pursuant to Court notices respondent no.2 SIP Muzafar Hussain Soomro has submitted his comments along the annexures, wherein it has been stated that FIR No.2/2010 registered at Police Station Areeja has been recommended to be disposed of under section 173, Cr.P.C as ‘B’ class and the matter is pending for approval or otherwise before the concerned Magistrate.

                        Mr. Nisar Ahmed G. Abro advocate has filed Vakalatnama on behalf of proposed accused, who confirms such contention and states that instant petition has become infructuous.             

            While confronted with the above facts, learned counsel for the petitioner does not press the instant petition. However, states that the petitioner will seek remedy in accordance with the law.

                        Accordingly, the instant petition is dismissed as not pressed.
