The petitioner is son the of one Abdul Wahab Tunio, who served in Irrigation Department as Beldar and was retired after completing superannuation, has filed instant petition seeking his appointment as Beldar in place of his father, in terms of Rule 11-A, of Sindh Civil Servants (Appointment, Promotion & Transfer) Rules, 1974.
Comments were called from the respondents who have filed the same wherein it has been stated that there is no rule or Government policy whereby appointment, on the basis of son quota could be made. Learned Addl. A. G has further pointed out that provisions of the Rule 11-A of Sindh Civil Servants (Appointment, Promotion & Transfer) Rules, 1974 are not attracted in the instant case.
When the counsel was confronted with such objection he has conceded to the legal position as stated hereinabove, however stated that he will not press the instant petition if the respondents are directed to consider the case of the petitioner for appointment as Beldar whenever such posts are fallen vacant on sympathetic grounds.
Accordingly, we do not find any merits in the instant petition which is hereby dismissed. However, petitioner, if eligible for such post, is at liberty to apply for the appointment as Beldar with the respondents whenever such posts are advertised, where-after he may be considered as per rules.
