                        Mr. Jhamat Jehanand, learned Counsel for Respondent No.4 contends that the Respondent No.4 is only in possession of 23.17 acres of the land to which there is no dispute. As to the remaining portion of Survey No.831 which is 6-24 acres, the respondents No.4 has nothing to do with it. However, Mr. Jhamat states that since the remaining portion of Survey No.831 has not been allotted to the petitioner, the respondents have all right to seek its allotment from the concerned authority. He also undertakes that respondent No.4 will not take over the Survey No.831 before entitlement is decided by the Government of Sindh. Likewise, Mr. Abul Inam, the learned counsel for the petitioner undertakes that the petitioner will not tress pass upon the land of respondent No.4 measuring 23.17 acres.

                        The petition by consent stands disposed of in the above terms alongwith listed applications.
