                        Through this petition, petitioner seeks directions to the Secretary Education as well as EDO Education Shaheed Benazirabad for issuance of appointment letter on deceased son’s Quota. Counsel for the petitioner contends that father of the petitioner expired on 19th May 2003 and thereafter petitioner being the elder son applied for the post of Chowkedar against deceased son’s Quota. Counsel has referred to various applications forwarded by the Principal to District Office Education as well as EDO Education ranging from 03rd July 2003 to June 2006.

                        EDO present states that in accordance with the amendment made in Section 11 (a) in accordance with policy of the Government as enunciated in notification dated 17th July 2009, cut-off date for appointment under deceased Quota to the posts of BS-1 to BS-15 is 17th July 2007. However, he admits that since the case of present petitioner is of 2003, therefore, the petitioner is not hit by said notification and if directed, necessary appointment order will be issued.

                        In the circumstances, since the entitlement of petitioner against son’s Quota has been admitted, therefore, EDO (Education) Shaheed Benazirabad shall issue appointment letter in favour of the petitioner to the post of Chowkedar/Peon within one month.

                        The petition stands disposed of in the above terms.
