Counsel for the Petitioner contends that the Petitioner was appointed as peon on contingency basis in the year 1992 and he served in Government Girls High School, Latifabad, as such till 1995. Per learned counsel, the Petitioner after a lapse of four years was again retained in service on contingency basis under Parent-teachers Association Fund, in the year 1999 and was relived on 3.6.2006. It is contended that thereafter various other persons were appointed as peon but the Petitioner was totally ignored and as such was being discriminated.
On the other hand, the E.D.O. present states that not a single person was appointed as peon in Government Girls High School, Latifabad and further states that in case any vacancy arises in the institution or if any person is kept even on contingency basis, the Petitioner would be provided first opportunity. He further states that they will ensure that no other person except Petitioner is appointed in this school on the said post.
Mr. Saulat Razvi shows his satisfaction on such statement but requests that since the post is available but the funds are not provided by the respondents, therefore, they may be directed to provide funds for the said post.
The request appears to be reasonable. We while disposing off this petition on the basis of statement of EDO direct that in case the aforementioned post is available then the respondents may consider providing of funds and appointing the Petitioner on such post.
