Asif and Nazir arrested in the crime are produced in custody.

            In consequent to the direction dated 19.5.2010 Investigating Office has affected appearance and has placed on record that the brother of Petitioner had lodged Crime No. 192 of 2010 at P.S Tando Adam City reporting the abduction of the Petitioner and has also produced Asif and Nazir arrested in consequent to the said Crime. He has further recorded the statement of Petitioner wherein she has denied her abduction.

            The Petitioner present in Court reiterates that she has not been abducted by any one on the contrary she being sui juris of 22 years has married Muhammad Boota and his brother has lodged a false report.

In view of this position neither the Investigating Officer nor learned Additional Advocate General Sindh supports the crime. We are also of the view that since the abductee herself has denied her abduction therefore prosecution of the instant crime is nothing but sheer abuse of process. In the circumstances, we hereby quash the proceedings emanating from Crime No. 192 of 2010 of P.S Tando Adam City U/s 365-B, 34 PPC and direct the release of all arrested in consequent to the said Crime forthwith. 

The petition stands disposed of in the above terms.
