Mr. Peer Sajjad Ali Shah, Advocate a/w petitioner.

Mr. Muhammad Azeem Panhwar, State Counsel a/w Muhammad Parial Abbasi, HC/I.O PS Qazi Ahmed.

                                                =

Through instant petition Mst. Rooma has sought the order seeking quashment of Crime No.124/2010 of PS Qazi Ahmed U/s 365-B P.P.C. registered against her husband and his relatives. On 26th May 2010, the petitioner had stated before us that she has not been abducted by any one, on the contrary she has married Zulfiqar and such act of her has annoyed her father who has lodged a false F.I.R. reporting her abduction. She further stated that some of her husband’s relatives have been arrested in the said crime. Consequently, we directed the concerned SHO to produce the persons so arrested in the said crime. On 27th May 2010 one Mashooque Ali, the brother of petitioner’s husband was produced who was set at liberty by us upon execution of P.R Bond in the sum of Rs.100,000/- and the matter was adjourned for today for final disposal. Today the I.O of the case has recorded the statement of petitioner who reiterates that she has not been abducted by any one and she has married one Zulfiqar which has resulted the registration of false crime.

In the circumstances, the learned State Counsel as well as I.O does not support the F.I.R. We are also of the view that since the alleged abductee herself has denied her abduction therefore, no successful prosecution of the case can take place. In the circumstances, we quash the proceedings emanating from said crime and the P.R Bond executed by Mashooque Ali is hereby cancelled.

The petition stands disposed of in the above terms.
