The basic grievance of the petitioner against the official respondents is that they are not acting in compliance of the decree made in their favour and F.C.S.No.28/2006 which was decreed by the Senior Civil Judge Naushero Feroze by means of judgment and decree dated 06.6.2006. The learned counsel submits that even that execution proceedings are pending in respect of that decree, the executing court has stayed its hand because of the learned counsel claims is a collusive application u/o 12(2) CPC has been filed in the civil proceedings and has remained pending adjudication for a number of years.

The learned counsel is satisfied, if this petition is disposed off with appropriate directions to the Civil Court to expeditiously to dispose off the pending application. This application is disposed off in terms that the Civil Court is directed after due notice to the parties to dispose off the application u/o 12(2) CPC within 30 days from the date of which a certified copy of this order is placed on the record of Civil Court, in case the Civil Court is unable to dispose off the said application within 30 days and shall file this report in this court for giving the detailed reasons.

Petition stands disposed off alongwith listed application.
