            Through this High Court Appeal, the Appellant has challenged the judgment and decree dated 10.12.2018 passed by the learned Single Judge of this Court in Suit No.804 of 1991, whereby the suit was dismissed with costs and the reliefs sought by the Appellant/Plaintiff were declined. However, while dismissing the suit, the learned Single Judge observed that the Appellant/Plaintiff may approach the Administrator of Defendant No.2 for compensation in respect of the improvements/construction allegedly made by him over the subject property. It was further directed that, if such an application is made, the Administrator shall consider and decide the same fairly, keeping in view the actual circumstances of the case, within a reasonable time.           

Learned counsel appearing for the Appellant, while referring to paragraph-14 of the impugned judgment, as referred above, submits that the Appellant does not wish to further proceed with this appeal and intends to approach the Respondent No.2 for compensation in terms of the observations and directions contained in the impugned judgment and decree. Learned counsel appearing for the Respondents extends no objection to such course.

Accordingly, the instant High Court Appeal is dismissed as not pressed, leaving the Appellant at liberty to approach the Respondent No.2 in terms of the observations and directions contained in the impugned judgment and decree. In the event such an application is made, the same shall be considered and decided by the Administrator in accordance with the directions contained in the impugned judgment and strictly in accordance with law.
