Learned counsel for the petitioners, through this Constitutional Petition has prayed as under :
a) That this Honourable Court be pleased to accept the instant petition and further be pleased to admit for regular hearing.
b) That this Honourable Court may be pleased to direct the respondents no.1 and 3 to accept the nomination/recommendation of the plot donor vide his affidavit placed as annexure-J and the petitioners may be given their appointment in view of the annexure-J and in continuation of their offer orders vide annexure-A and B.
c) That this Honourable Court be pleased to direct the respondent No.1 and 3 to issue appointment order in continuation of offer orders being no.(SO(G-1) EDU/E&RECT-MSP/285 of 2006, dated. 01.8.2006 in favour of petitioner No.1 for the post of Sanitary Worker at Middle School (Boys) at village Haji Abdul Karim Unar of Taluka Dokri and No.SO(G-1)EDU/E&RECT-MSP/286 of 2006, dated 01.8.2006 in favour of petitioner No.2 for the post of Sanitary Worker at Middle School (Girls) at village Haji Abdul Karim Unar of Taluka Dokri and report compliance before this Honourable Court with directions to respondent No.1 to comply the orders of this Honourable Court vide dated 11.11.2008.
Learned counsel for the petitioner has contended that one Imdadullah Khan Unar landlord had donated the plot for construction of Middle School Boys and Girls free of cost. He has further contended that the petitioners are the ‘Haris’ of Imdadullah Khan Unar, therefore, they were recommended by him for the posts of Naib Qasid and Sanitary Worker. It has further been contended by the learned counsel for the petitioners that the construction of building for Middle School (Boys) had been completed and the education process is being run. He lastly contended that following the policy framed by the Government of Sindh vide Notification dated 9th July, 1990, the petitioners may be given appointment orders.
Mr. Abdul Hamid Bhurgari, learned Addl. A. G has contended that the land lord has donated one plot and on the same plot two Schools have been constructed; one for boys and other for girls. Mr. Bhurgari states that the respondents are ready to appoint one person as Naib Qasid or Chowkidar.
Mr. Muhammad Saleem Jesar learned counsel for the petitioner was asked if he agrees with the proposal given by Mr. Bhurgari, then Mr. Jesar has acceded with the proposition given by Mr. Bhurgari.
Consequently, we direct respondents to appoint the petitioner No.1 in Basic Pay Scale 1 or 2 within two weeks. With the above observation, this petition stands disposed of.
