            Applicant/accused Muhammad Saqib son of Muhammad Sadiq seeks interim pre-arrest bail in FIR No.269/2025 registered at P.S. Malir City, Karachi for offence under section 324, 34, PPC, after dismissal of his bail plea by learned Additional Sessions Judge-VIII Malir Karachi.

            Learned counsel for applicant, after arguing the instant bail application at some length, does not press the same, and requests that the same may be converted into protective bail in order to enable the applicant to appear before learned trial Court as learned trial Court has dismissed his pre-arrest bail before filing of final challan and now the final challan has been filed and Section 109, PPC is added, in which role of abetment has been assigned to the present applicant and the learned trial Court has not discussed this issue in its order.

            Learned A.P.G. as well as learned counsel for complainant have not opposed on such proposal.

In view of above, instant criminal bail application is converted into protective bail and, without touching the merits of the case, protective bail is granted to applicant above named, for a period of five (5) days from today, on the same surety already furnished by him before the Nazir of this Court in the instant criminal bail application. Applicant is directed to surrender before the trial Court in the aforesaid period and join the trial forthwith. This order shall cease to have its effect after expiry of five days from today or whenever the applicant surrenders before trial Court, which one occurs earlier. It is made clear, in case, applicant fails to surrender before the trial Court in the aforesaid period, his bail bond shall stands automatically forfeited.

 

            The instant criminal bail application is accordingly disposed of.
