This
criminal miscellaneous application was filed on 11.04.2023. Record reflects
that none appeared on behalf of applicant on 01.12.2025, however, on
07.01.2026, counsel for applicant sought time for preparation. This is second
round when the applicant and his counsel are called absent. Learned counsel for
respondents 3 to 6 has filed statement along with order dated 26.03.2025,
passed by learned Civil Judge & Judicial Magistrate-XII, Malir, Karachi in Criminal Case No.106/2023, arising out of
FIR No.114/2023 of PS SSHIA, Karachi for offence under Section 381A, 109, 34,
PPC, whereby learned trial Court stopped the proceedings against accused Mirza Raheel Baig,
Syed Karim Shah, Raheem Zada and Ghulam Rasool, without any order either of acquittal or
conviction, under Section 249, Cr.PC. Since the
applicant and his counsel are not appearing, which reflects
that they have lost interest in pursuing this criminal miscellaneous application,
which is accordingly dismissed on account of non-prosecution.
