Azeem Sarwar son of
Muhammad Sarwar has filed application under Section
561-A, Cr.PC for quashment
of FIR No.301/2024, registered at P.S. Market, Hyderabad, for offence under Section
489-F, PPC. Learned counsel for applicant was directed to satisfy the Court on
the point of maintainability of instant application. Learned counsel for
applicant after arguing the matter at some length requests that this criminal
miscellaneous application may be converted into protective bail in order to
enable the applicant to appear before learned concerned Court. He seeks further
direction for early disposal of the case. Mr. Sharafuddin
Kanhar,
learned A.P.G. present in Court in some other cases, waives notice and has
recorded no objection on the requests made by learned counsel for the
applicant.
In view of above, instant Criminal Miscellaneous
Application No.941/2025 is converted into protective bail, with direction to
the office to assign number to it accordingly. Applicant Azeem
Sarwar son of Muhammad Sarwar
is admitted to protective bail for a period of eight (8) days from today, subject
to furnishing solvent surety in the sum of Rs.50,000/-
(Rupees Fifty Thousand) and P.R
bond in the like amount to the satisfaction of the Nazir of this Court.
Applicant is directed to surrender before the concerned Court in the aforesaid
period and join the investigation/trial forthwith. This order shall cease to
have its effect after expiry of eight days from today or whenever
applicant/accused surrenders before the trial Court, which one occurs earlier.
It is made clear, in case, applicant/accused fails to surrender before the
trial Court in the aforesaid period, his bail bond shall stand automatically
forfeited. However, learned trial Court is directed to decide the case of the
applicant expeditiously, preferably within a period of three months. Office is
directed to communicate this Order to the IO of FIR No.301/2024, registered at
P.S. Market, Hyderabad, for offence under Section 489-F, PPC as well as learned
trial Court concerned for compliance.
The
instant criminal miscellaneous application is accordingly disposed of.
