Applicant
Syed Muzammil Ahmed son of Syed Ahmed Hussain seeks post arrests bail in FIR No.178/2024,
registered at P.S. Quaidabad for offence under
Section 489-F, PPC, after dismissal of his bail plea by learned Additional
Sessions Judge-VIII, Malir, Karachi vide order dated
19.09.2025.
It is
alleged in the FIR that applicant has issued a Cheque
in favour of complainant to the tune of Rs.800,000/-; co-accused Naveed has also
issued Cheque of Rs.1,100,000/- to the complainant.
During investigation, co-accused Naveed was admitted
to post arrest bail on the ground of no objection given by complainant in his favour.
Learned
counsel for applicant submits that applicant is behind the bar since last 9
months, without any progress in trial. He further submits that applicant is
suffering from kidney problem, such report has been submitted by the Medical
Officer of Central Prison and Correctional Facility, Karachi, which reveals
that applicant needs dialysis if needed. He further
submits that the applicant is suffering from renal disease and he needs
dialysis, which is very difficult from inside the jail.
Learned
A.P.G. opposed for grant of bail on the ground that applicant has given cheque to the complainant, which upon submission to the
Bank was dishonoured, hence he is involved in an
offence under Section 489-F, PPC.
Heard
learned counsel for the applicant as well as learned A.P.G. and perused the
material available on record.
It is
matter of record that co-accused Naveed has already
been admitted to bail by learned trial Court vide order dated 27.04.2024 on the
ground of no objection extended by complainant in his favour.
It has come on record that applicant is suffering from renal disease and as per
the report of Medical Officer, Central Prison, Karachi he might need dialysis
due to his critical condition and such treatment is very difficult inside the
jail. Therefore, the applicant/accused is admitted to post arrest bail, subject
to his furnishing solvent surety in the sum of Rs.100,000/-
and P.R. bond in the like amount to the satisfaction of the trial Court.
Needless
to mention here that the observations made hereinabove are tentative in nature,
the same would not influence the trial Court while deciding the case of the
applicant/accused on merits.
Instant
criminal bail application is disposed of in the above terms.
