       Mr. Iftikhar Javed Qazi states that the evidence has been recorded in Suit No. 569/97 & 570/97 subsequent thereof Mr. Muhammad Ejaz Alam Siddiqui proceeded to file Suit No. 1339/2004, in which the issues were settled on 2^nd May 2006. Mr. Nisar Mujahid learned counsel appearing for plaintiff in Suit No. 1339/2004 remained absent nor his party has appeared to pursue the case which is offshoot of the earlier cases pending adjudication concluded by way of recording the evidence could not be determined as offshoot arisen in the shape of Suit No. 1339/2004. Office is directed to issue notice to Mr. Nisar Mujahid for appearance on 13.2.2007 for determination of the issue whether the plaintiff is interested in recording the evidence in the above matter. Orders accordingly.
