This is a petition for grant of Letters of Administration under Section 278 of the Succession Act filed by the petitioners in respect of the estates of the deceased Capt. (Retd.) Muhammad Masood as arrayed in the schedule of property. All the petitioners have filed their affidavits of no objection and petitioners No.3 and 4 are present in Court, while affidavits of independent persons, namely, Syed Ammar Yasir Zaidi and Muhammad Owais Sultan, who are also present in Court, have also been filed. Affidavits of no objection have been filed for and/or on behalf of the petitioners No.1 and 2.
According to the report of Deputy Registrar (OS) of this Court, all the formalities including publication have been effected in the newspaper, but none has filed any objection and there is no impediment for grant of Letters of Administration.
Accordingly, this petition is allowed. Let Letters of Administration be issued as per rules so that the records of rights of the deceased’s properties may be changed in favour of all the petitioners and legal heirs of the deceased. The original title documents of the properties will remain as security with the Nazir of this Court.
This petition stands disposed of accordingly.
