Counsel for the Petitioner contends that the Respondents have recently provided 186 electricity connections to illegal occupants of different colonies of the Petitioner-Mill whereas 179 other illegal occupants are consuming electricity by illegal means. It is contended that the said connections have been given without permission of the Petitioner-owner and either such connection be removed or the electric charges be recovered from such illegal occupants without any liability on the property of the Petitioner or the premises
On the other hand Mr. Bukhari states that all connections have been given in the names of the occupants and the bills are being issued to them and payment received directly. He states that all the electricity charges will be recovered from the occupants/consumers and in case any of the occupants fails to pay the electricity charges the electricity connection shall be disconnected.
We have heard the learned Counsel for respective parties and have perused the record.
It appears that after termination of the services of these employees the Petitioner is in process of getting the premises provided to them vacated and perhaps have lodged proceedings. However, their right to have amenities on payment of charges cannot be disputed or denied.
In the circumstances, we dispose of this petition with direction to the Respondents to recover all the dues of electricity from the consumers on month to month basis without posting any liability of the electricity consumed. We further direct the Respondents to ensure the removal of all illegal electricity connections, if any, as complained by the Petitioner within a week and to report compliance.
The listed application also stands disposed of.
