Through the instant petition, the Petitioner seeks quashment of FIR in Crime 17/10, P.S Makki Shah, U/s 365-B, 34 PPC.

The Petitioner present along with her husband namely Farazuddin states that she being sui juris by exercising her right of free will has entered into a contract of marriage with Farazuddin, which has caused annoyance to her parents resulting in the instant FIR. She has categorically denied the allegation of abduction by any one.

On 31st March 2010 notice was issued to the learned Additional Advocate General Sindh and I.O was called. Today the I.O has appeared and recorded statement of Petitioner wherein she has reiterated her statement.

Mr. Allah Bachayo Soomro, Additional A.G. Sindh as well as the I.O. state that in view of the statement of petitioner, the FIR and the proceedings emanating there from cannot sustain.

In view of the statement of the Petitioner, FIR bearing Crime No. 17 of 2010 of P.S Makki Shah, U/s 365-B, 34 PPC as well as proceedings emanating therefrom are quashed.

            The petition stands disposed of in the foregoing terms.
