3) Applicant Muhammad Azam Khan applied for Pre-arrest bail under Section 497/498 Cr.P.C. in Crime No. 289/2006 under sections 147/148/ 448/506-B/355-A/337-A-1/504 PPC registered at P.S. Shahrah-e-Noor Jehan.
Learned counsel for applicant contended that the allegations levelled by the complainant Mst. Nazo W/O Noor Muhammad are baseless and controverted by Ilaqa Nazim Mubin Khan in a certificate, issued by him as he was also present when the applicant and the complainant party were brought by the police at police station. It is further contended that no injuries were sustained by the complainant as a result on the allegation of alleged beating and torning of cloths. Without dilating on the merits of the case, the applicant is admitted to interim Pre-Arrest bail subject to furnishing surety in the sum of Rs. 50,000/- (Rupees fifty thousand only) and personal recognizance to the satisfaction of the Nazir of this Court. Issue notice to learned Advocate General Sindh for 9.11.2006.
