                   On the last date of hearing the Petitioner was not in attendance and learned Additional A.G Sindh had drawn the attention of this Court that the Petitioner was appointed as Chairman, District Zakat & Ushr Committee, Tando Allahyar for a term which had expired on 29-10-2009 after three years and as such this Petition had become infructuous. In the interest of justice, this Court had issued notice to the Petitioner for today’s attendance in Court but today no one is in attendance nor any intimation is received.

                   It appears that in view of above position the Petitioner has lost interest in pursuing the instant Petition. Under the circumstances the Petition is dismissed for non-prosecution along with listed application.
