                        This application was received from jail by the applicants namely Abdul Latif s/o Lashkari Khan Chandio and Mukhtiar s/o Rahim Bux Chandio who were charged in Criminal Case No.461/2009. This Court converted the application of the applicants into bail application and called comments and R&Ps from the jail authorities. In response to the order of this Court, the Superintendent District Jail Dadu vide its letter dated 29.3.2010, has sent R&Ps and submitted report which reads as follows:-

‘It is submitted that accused 1. Abdul Latif S/O Lashkari Khan Chandio and 2. Mukhtiar S/O Raheem Bux Chandio have been released on Acquitted U/S 245 (i) Cr.P.C from this Jail on 15.01.2010 in case U/S 457, 382 PPC, Crime No.461/2009 of PS Dadu by the orders of Honourable IInd Civil Judge & Judicial Magistrate Dadu vide Order No.74 dated 15.01.2010. At present the above named accused are not confined in this Jail.’                 

                        The learned DPG has also examined the R&Ps and report and states that since the accused persons have duly been released from the jail, the instant bail application has become infructuous.

                        Accordingly, the instant bail application is dismissed for having become infructuous. The office is directed to return the R&Ps.
