Learned counsel for the petitioner has filed an application claiming for exemption from furnishing two sureties. In her application bearing No. 311/2010 it has been prayed on behalf of the petitioner that the title documents of property shown at Sr. No. 1 of the Schedule B in respect of Flat No. A/3, on Plot No. ST-4-D, situated at Block – 20, Federal ‘B’ Area, Karachi measuring 107.7 Square Yards, may be received as surety on the ground that property No. 2 in the Schedule is already mortgaged with NIB.

I think there is judgment passed by his Lordship Mr. Justice Saeed-uz-Zaman, Siddiqui, as he then was, wherein it has been held that for grant of Letter of Administration two sureties are required and it is mandatory provision of law. Learned counsel may bring that case law and then make her submissions in this case. Adjourned to a date in office.
