            In consequent to notice issued by this Court on 31.3.2010 Mst. Rozina has been produced by ASI Ali Haider alongwith Achoo the father of Mst. Rozina. Mst. Rozina has categorically stated before us that she being suijuris has married Kalo with her own free will which has caused annoyance to Respondent No.4 her father who has forcefully taken her and detained.

            ASI present states that Respondent NO.4 has lodged crime No.19 of 2010 at Police Station Kunri alleging abduction of Mst. Rozina by Kalo.

            Since Mst. Rozina has affected appearance before this Court and has categorically denied her abduction and has stated that she wants to go with her husband the Applicant, therefore, we directed the recording of her statement.

            In her statement she has again affirmed that she has not been abducted and has married the Applicant Kalo and she wants to go with him.

            In view of this position learned Additional Advocate General Sindh, does not support the F.I.R.  We are also of the view that after the statement of Mst. Rozina, no fruitful purpose would be served in prosecuting Applicant or any one else emanating in crime No.19 of 2010. Consequently we quash the proceedings emanating from crime No.19 of 2010.

            This criminal miscellaneous application stands disposed of.
