Ms. Tabassum Khan, Advocate has filed power on behalf of the respondent, which is taken on record.
Learned counsel for the petitioner states that the petitioner has vacated the premises by 31.05.2010 in terms of order dated 19.03.2010 passed by this Court and the petitioner has also been directed to deposit monthly rent and utility charges till he is enjoying the demise premises.
Petitioner may enjoy the premises till 31.05.2010 and will vacate the same by the said date subject to deposit monthly rent due against him and future rent upto the above said stipulated period with the Nazir of this Court within a week time.
In view of the above position, since the petitioner has been allowed to retain the possession of the premises by 31.5.2010, therefore, this petition having become infructuous and is accordingly disposed of. In case the premises is not vacated by the above said date writ of possession will be issued in terms of order dated 19.03.2010.
This petition stands disposed of in the above terms.
