O R D E R

Learned counsel for private respondents initially required time however, as the learned counsels were being heard and in the present case it was found that the challan submitted before the concerned Magistrate had himself directed the complainant to approach the learned Sessions Judge it was agreed that the impugned order dated 25.08.2025 as passed by the Court of Additional Sessions Judge/MCTC Ubauro in Crl. Misc. No.- of 2025 Sessions Case No.131-A/2025 re-State v. Hamadullah requiring the present applicants to be brought in for proceedings on an application u/s 190(3) Cr.P.C alongwith the order passed by Judicial Magistrate-II, Ubauro in Crl. Case No.168 of 2025 re-State v. Hamadullah & others for acceptance of the said challan directing the complainant for the same, both be set-aside and it is so ordered. Accordingly, both the said orders are hereby set-aside and the concerned Magistrate is directed to pass a speaking order after providing opportunity of hearing to the parties as to their grievance and acceptance of the challan and thereafter proceed with the same in accordance with law.

This Crl. Revision stands disposed of in the above terms.
