Applicant Saeed Ahmed Khan S/O Allah Ditta has applied for bail in Crime No. 66/2007 under section 420, 468, 471, 473, 34 PPC registered at police station CID Sindh Karachi on the basis of report of Sub Inspector Kamdar Khan the applicant was arrested on the basis of spy information along with co-accused. From the possession of the applicant 10 fake driving licenses were recovered. The applicant along with co accused was arrested.
Mr. Raza Hashmi learned counsel for applicant has contended that offence does not fall within the prohibitory clause under Section 497 Cr.P.C, challan has been submitted, the applicant is no more required by the investigating agency. It is also urged that the mother of the applicant has expired today, this fact is substantiated from the certificate issued from Casualty Medical Officer Civil Hospital Karachi.
Mr. Fazlur Rehman Awan learned State counsel has conceded to the above facts.
Having regard to the facts and circumstances of the case, allegation levelled against the applicant requires further inquiry within the ambit of subsection 2 of section 497 Cr.P.C. therefore applicant is admitted on bail subject to furnishing surety in the sum of Rs. 50,000/- (Rupees fifty thousand only) and P.R. bond in the like amount to the satisfaction of the Nazir of this Court.
