The petitioner has impugned the demand of the house tax, conservancy tax and demand notice fee, which was being sought to be executed by XV Civil Judge and Judicial Magistrate and Cantonment Magistrate, at Karachi (East), in Application No.50/2008. Learned counsel for the respondent has candidly conceded that the respondent No.1, who passed the order after giving an opportunity of being heard to the petitioner. Let petitioner file the review application within two weeks from the date of hearing and the authority will decide the matter preferably within 30 days thereafter.

Under the circumstances, the impugned order dated 29.08.2008 is accordingly set-aside.

The petition stands disposed of in the above terms alongwith listed application.
