Learned counsel for the respondent pointed out that the matter was dismissed for non-prosecution and is fixed for hearing of restoration application. According to the learned counsel for respondent, the petitioner is not taking any interest to pursue the matter. The matter is being reluctantly adjourned to 22.03.2010 on which date if nobody appear on behalf of the petitioner the application for restoration may be dismissed for non-prosecution.
