It appears that since filing of this appeal the appellant is not pursuing the matter. The matter was being adjourned on 29.05.2009 & 09.12.2009, nobody was in attendance. Today, the matter was called in the earlier part of the day and was kept aside and was taken up after recess at 11.30 a.m. neither the appellant nor the counsel are in attendance though repeatedly called.

Accordingly, the appeal is dismissed for non-prosecution alongwith listed applications.
