Mr. Raja Muhammad Iqbal, Advocate for respondent Nos.2 & 3 states that he has filed his Vakalatnama in office. Mr. Zain A. Jatoi, Advocate has filed his Vakalatnama in Court, which is taken on record.
It seems that petitioner has imported consignment of windscreen glass from abroad. The custom department has demanded duties and charges on the basis of valuation ruling. The petitioner counsel states that though petitioner will avail remedy against the order of the assessment based upon the valuation ruling by filing of the appeal before the Collector of Custom (Appeals) but the petitioner may be allowed to obtain consignment on payment of custom duties and charges, and if petitioner succeeds in the hierarchy of the customs, petitioner will be entitled to refund of the amount disputed by the petitioner.
Counsel for the respondents state that if the petitioner pays the duties and charges, it will be entitled to the release of the consignment and if petitioner ultimately succeeds in its challenge against the levy, the customs will make refund to the petitioner. In terms of the statement made by the respondents counsel, the petition stands disposed off along with listed application.
