It seems that the assessment order has been passed, against which the petitioner will have remedy of filing of an appeal. The petitioners' grievance is that its consignment is lying at the port, on which customs duties is being claimed on the basis of valuation ruling, which according to the petitioner is not in accordance with law. Such aspect of the matter will be considered by the appellate authority in the appeal which the petitioner may file. As regard, the release of the consignment, it is agreed between the counsel for the parties that the petitioner will deposit the undisputed amount of customs duty and charges and will provide to the customs authorities post dated certified/validated cheques by the bank in respect of the disputed amount, upon which the goods will be released.
The learned counsel for the petitioner submits that the petition be disposed of in the above terms. The petition with listed application is disposed off in the above terms.
The petitioners' counsel further states that the petitioners may be provided delay detention certificate by the customs department, such aspect will be examined by the customs authority and will pass proper order in accordance with law.
