The DIG East Zone, CCPO, Karachi as well as the Incharge Registrar have filed their reports pursuant to the order dated 05.3.2010. The exercise of identifying the persons on CCTV footage has remained inconclusive as the persons seen in the CCTV footage could not be identified because as stated by the learned AAG the footage were quite weak. The learned AAG states that he has instructions from the police officers to state that the alleged detenus are not in custody of police but they are wanted in the crime which have been registered against them vide Crime No.232/2010 of P.S Ferozabad and Crime No.70/2010, P.S Bahadurabad in which they have not been arrested as yet. The petitioner however insist that the alleged detenues have been taken away from her residence on 02.3.2010 and their whereabouts are still not known. The counsel for the petitioner states that the petitioner has sent three applications among them one has been sent to CCPO, the second to DIG East Karachi, with request to conduct inquiry and the third one to the SHO, PS Bahadurabad Karachi, requesting for registration of the FIR. All the three applications are dated 4.3.2010 and with them receipts of TCS are attached. The counsel for the petitioner states that so for the question of registering FIR is concerned the petitioner will approach appropriate court with an application U/s.22-A Cr.P.C but some order may be passed with regard to the recovery of the alleged detenues. The petitioner in her two applications have sought inquiry by the DIGP East. We therefore, direct the DIGP East, present in court to hold an inquiry for ascertain whereabouts and recover alleged detenues and have them produced in Court. The inquiry be conducted expeditiously and report in this respect be submitted by the next date. Adjourned to 15.3.2010.
