The petitioner was employed with the CDGK in BS-17 and was dismissed from service which order was challenged by him by filing an appeal No.382/2000, in Sindh Service Tribunal at Karachi, which appeal was decided vide order dated 06.1.2004, by which fresh inquiry was ordered and in the meanwhile the petitioner was directed to be reinstated in his service with the status of civil servant. It appears that pursuant to this reinstatement order the petitioner got himself reinstated as Deputy District Officer, BPS-18 through letter of reinstatement dated 09.2.2004 and through a letter of same dated i.e. 09.2.2004 as Deputy District Officer BPS-18, as stop-gap arrangement. It further appears that through letter dated 10.6.2004 of D.O.HRM, CDGK the petitioner’s appointment as DDO BS-18 was regularized w.e.f.09.2.2004. It appears further that subsequently CDGK, became aware of the fact that the petitioner has submitted forged / tampered order of the tribunal for getting himself reinstated in BPS-18, pursuant to which show cause notice dated 15.11.2008, was issued to him. It is stated that the inquiry against the petitioner is being conducted by inquiry officer but petitioner is not attending the same and on that account inquiry is lingering on. Under the circumstances we direct that the inquiry be completed within the period of three months. In case the petitioner does not appear before the Inquiry Officer the Inquiry Officer after due notice may proceed with the inquiry ex-party and decide the matter within above period. The petition is disposed of with the above terms alongwith listed applications.
