This criminal
miscellaneous application was filed on 20.07.2023 and office has raised some
objections and it was first time fixed before this Court on 07.12.2023 when the
counsel for applicant was called absent and on his behalf Ms. Tuba Asghar, advocate, held brief on his behalf. Thereafter,
this matter was again fixed on 27.02.2024 but the matter was adjourned due to
nonappearance of counsel for applicant. Again on 09.05.2024, matter was fixed
before the Court but no one appeared, therefore, the matter was adjourned and
notice was issued to the applicant. On 23.10.2024, Syed Yousuf,
advocate, filed power on behalf of applicant and sought time for compliance of
office objections but he did not comply with the same since 23.10.2024. Today
again, counsel for applicant seeks time for compliance of office objections.
Two years’ time has been passed but the applicant has not complied with the
office objections and even today the matter is fixed for non-prosecution.
Continuous non-compliance of office objections shows that applicant and his
counsel have lost interest to pursue their case,
therefore, instant criminal miscellaneous application is dismissed for
non-prosecution along with pending applications, if any.
