            Along with urgent application, application for return of surety is moved by applicant/surety. It appears during pendency of instant appeal, appellants Muhammad Aslam Gulzar and Muhammad Salahuddin Mughal were released on bail subject to furnishing solvent surety in the sum of Rs.50,000/- each and P.R. bond in the like amount to the satisfaction of the Nazir of this Court. As per endorsement of Nazir, one Rabiuddin Mughal son of Salahuddin Mughal furnished surety for appellants by way of depositing cash Rs.100,000/-.

 

            Counsel for applicant/surety submits that appellants remained in attendance before this Court. However, this Court vide judgment dated 06.11.2024, reduced the sentence of appellants above named to one already undergone in custody, waived their fine and let them free to go. In view of such position, the surety furnished is no more required, the same may be ordered to be returned to the applicant/surety. Learned A.P.G. present in Court in some other cases waives notice and after having gone through the case file and judgment dated 06.11.2024 has recorded no objection for return of surety.

 

            In view of above, surety furnished in the instant appeal is no more required. Application for return of surety is allowed. Office is directed to return the surety to the applicant/surety upon proper verification and identification, as per rules.
