1. By this application appellant Soomar S/o. Sukhio Khaskheli has sought suspension of the sentence against him.

Learned counsel contends that the appellant Soomar was sentenced to life imprisonment by the impugned judgment and as per the jail roll made available by the Superintendent, Central Prison, Hyderabad, on the record the said appellant has already undergone sentence of more than 20 years and still his appeal has not been decided. He further contends that the role assigned to the appellant Soomar is only that of an instigation and not a role of causing murder.

Learned DPG on the ground that the appellant Soomar S/o. Sukhio Khaskheli has already remained in jail for more than 20 years concedes to the request for suspending his sentence.

Consequently the application is allowed and the sentence against the appellant Soomar S/o. Sukhio Khaskheli is suspended on his furnishing surety in the sum of Rs.200,000/- and P.R. Bond in the like amount to the satisfaction of the Nazir of this Court.
