At 05:05 p.m. counsel for the applicant has appeared and requested that through bonafide mistake he could not appear in Court on both occasions when the case was called up today. He states that on account of Lawyers’ strike yesterday, he could not obtain cause list for today and it was only through his Court Clerk he learnt about fixation of the case but by the time he reached the Court he found that it was dismissed for non-prosecution. He states that his non-appearance before the Court was altogether bonafide and was for the reason beyond his control and request that matter be restored.  

It appears that matter was fixed for Katcha Peshi and so far the notice to other side has not been ordered. In the circumstances and for the reasons stated in the application by the counsel we allow the application and restore this Criminal Acquittal Appeal to the file. Both the applications are disposed off.
