          After hearing the learned counsel for the parties at considerable length, by consent this Special Sales Tax Reference Application is disposed of by setting aside the order of the Tribunal so also the Order-in-Original No.021 of 2003, dated 28.02.2003 of the Collector, Sales Tax Department and the case is remanded to the Commissioner (Appeals) Sales Tax Department with direction to rehear and decide the same on the basis of the material collected by the Sales Tax Department independent of the purported admission through statement dated 26.08.1999 made by Muhammad Iqbal, Director of the Applicant. The Commissioner (Appeals) will decide the appeal within a period of three months and in case of filing of an appeal before the Tribunal, the Tribunal will also decide the appeal within a period of three months.
