4.       It is, inter alia, contended by learned counsel that main accused Nayyar Bari in FIR No. 05 of 1997, vide order dated 04.1.2010 passed in Constitutional Petition Nos.2820 to 2838 of 2009, has been granted interim pre-arrest bail on his furnishing surety in the sum of Rs.200,000/-(Rupees two hundred thousand only) in each of the petition. He has contended that petitioner was also implicated in the said FIR No. 05 of 1997 in respect of which 11 challans were submitted against him in the Court of Special Judge Anti-Corruption Sindh at Karachi which challans were subsequently, transferred to NAB Court as 11 Nab References. It is contended that petitioner who was working as Deputy Director General Textile Quota Management Department, retried on attaining superannuation in January 1996 and that since long he has been living abroad and suffered from heart ailment and being a person of advanced age, interim pre-arrest bail may be granted to him.

         

          In the circumstances, without adverting to the merits of the case, the petitioner is admitted to interim pre-arrest bail on his furnishing surety in the sum of Rs. 200,000/- (Rupees two hundred thousand only) and P.R.Bond in the like amount to the satisfaction of the Nazir of this Court in each of the petition.

 

          Issue notice to respondents and Deputy Prosecutor General, NAB for 25th February, 2010.
