                        Mr. Sajid Hussain Mahessar holding brief on behalf of Mr. Ghulam Shabir Baloch, advocate for the petitioner, submits that latter is busy before another Bench of this Court and seeks time. However, when confronted with the comments of respondent No.2, which reveals that anxiety of the petitioner has been over, seeks disposal of the petition. Learned AAG while drawing attention of Court towards said comments submits that the petitioner has been granted move-over from BPS-19 to BPS-20 with effect from 01.12.2001 vide Notification dated 25.7.2013; hence, in view of the comments submitted by respondent NO.2/Special Secretary Health, Govt. of Sindh, he also seeks disposal of the petition.  Before parting with the order, it will be appropriate to reproduce the para-3 of the comments of respondent No.2, which reads as under:-

 

“3.        It is respectfully submitted that on the recommendation of the Moveover Committee of Services General Administration & Coordination Department and with the approval of Chief Minister Sindh, the petitioner had been granted Moveover from BPS-19 toBPS-20 w.e.f 01.12.2001vide SGA&CD’s Notification dated 25.07.2013 (Annexure-II). Therefore, nothing is pending of the petitioner in this department. However, for financial benefits in pursuance to above said notification, he(petitioner) may approach to District Accounts Officer, Kambar Shahdadkot at Kambar for the purpose. Hence the name of the respondent No.2 (i.e. Secretary Health) may be deleted from the list of respondents.”

 

                        In the light of above submission as well as comments filed by respondent No.2, the purpose of petition has been served. Accordingly instant petition is hereby disposed of along with pending application(s), if any.
