O R D E R
OMAR SIAL, J.- Dost Mohammad has filed this application with the prayer that an F.I.R. be registered against certain police officers.
2. Applicants counsel submitted that a man named Kabeer was arrested in a crime arising out of F.I.R. No. 223 of 2022, registered under sections 395 and 457 P.P.C. at the Saddar police station in Jacobabad. Kabeer was, however, let off by the express instructions of the S.S.P. Jacobabad. Counsel argued that an inquiry was held by the police itself in the matter and it was concluded that the S.S.P. is indeed guilty. His stress, therefore, was that an F.I.R. against the S.S.P. be registered.
3. I am saddened to see that what the applicant’s counsel submits is misconceived and incorrect. Counsel was asked to read aloud the findings of the inquiry and conceded that no such finding was given against the S.S.P after reading it. To the contrary, the inquiry report concluded that the complainant himself had asked the police to let Kabeer off as he had felt sorry for him and that he was a relative of the complainant and had only confessed to the offence because of fear of the police. Suffice it to say, the complainant had vouched for Kabeer's innocence.
4. There has been an increase in complaints against the police in recent times. At times, applications are moved against senior police officials who have no foundation or basis and are simply filed to pressurize, blackmail, and de-motivate the police. The current application seems to belong to this category and appears to have been filed with ulterior intent. S.S.P. Jacobabad has been unnecessarily drawn into this controversy. A senior functionary of the State being involved in such an incorrect manner cannot be condoned. The respect and dignity of all institutions of this country, including the Sindh police, must not so easily be permitted to be trampled upon.
5. Given the above, the application is dismissed. Dost Mohammad s/o Ghulam Nabi Kharani is imposed a penalty of Rs. 200,000/-. The amount will be deposited with the learned Additional Registrar of this court within two weeks and used towards this court's clinic. If the penalty is not deposited within the specified time frame, the investigating officer of F.I.R. No. 223 of 2022 shall detain Dost Mohammad s/o Ghulam Nabi Kharani and produce him in this Court.
6. Let a copy of this order be sent to the S.S.P. Jacobabad and the concerned investigating officer for information and compliance. The application being dismissed shall only stay alive to ensure compliance.
