Petitioner Sikandar Ali Mirani, has filed this constitution Petition under Article 199 of The constitution of Islamic Republic of Pakistan 1973, seeking directions to the official respondent to produce Mst. Uzma, his wife. In compliance of court orders Mst. Uzma has been produced she negates the contents of memo of petition and submits that she is living with her second husband Bahadur Ali, and she is happy and want to go with him. Respondents No.2 and 3, have filed their comments which are taken on record. They also negates the allegations leveled by the Petitioner. In view of the statement of Mst. Uzma who is present in Court, she is set at liberty to go wherever she wishes. In view of such statement, this petition stands disposed of with directions to the police officials to get bond from Bahadur Ali and Sikandar Ali to ensure that no harassment is being caused to Mst. Uzma.

Learned Counsel for the Petitioner along-with petitioners submits that petitioners being adult and sui-juris have contracted marriage by entering to Nikah without consent of their parents i.e. respondents No.3 as such he is planning to file a criminal case against the petitioner No.2 and his family for alleged abduction of petitioner No.1 namely Mst. Nimra Mehar. The Petitioner No.1 present states that she has left the house of her parents according to her own accord and none has abducted here or enticed away her for any illegal purpose therefore, they needs protection as her parents intend to kill her by declaring her “Kaari”.
Learned Asst. Advocate General, Sindh, submits that no harassment shall be caused to the petitioners and the police will act in accordance with law. In view of such statement, this petition stands disposed of with directions to the police officials to ensure safety and protection to the petitioners.
