1. The certified copy of the impugned judgment has been filed in connected Cr. Appeal No.191/2009. Subject to all just exceptions, the office objection stands overruled.

2. Granted subject to all just exceptions.

3. This is an appeal filed by appellants namely Shoukat Masih and Pervez Masih. Shoukat Masih has earlier filed Cr. Jail Appeal No. 219 of 2009 which came up for hearing on 09.10.2009, when it was allowed and impugned judgment was set aside and he was ordered to be released forthwith if not required in any other case. The present appeal of Shoukat Masih has, therefore, become infructuous and is disposed off as such.

The appellant Pervez Masih has been convicted and sentenced by judgment dated 08.8.2009 passed by the Drugs Court, Sindh Karachi under various provisions of Drugs Act and has been sentenced to R.I. for three years and fine of Rs. 20,000/- in default of which further R.I. of three months with benefit of Section 382-B Cr.P.C. The appeal of appellant Pervez Masih being statutory is admitted to regular hearing. Call R&P and prepare paper book.

The learned DPG is in attendance who waives notice of admission of the appeal.
