            By this order I intend to dispose of this criminal revision application in which order dated 27.10.2023 passed by learned III-Additional Sessions Judge, Shikarpur in Sessions Case No.606/2021, against surety Liaquat Ali has been passed and fine of Rs.50,000/- was imposed upon him, as he failed to produce accused Makhno alias Muhammad Ameen before the trial court.

 

            Learned advocate appearing on behalf of the applicant/surety mainly submitted that accused Makhno alias Muhammad Ameen was confined in Jail in another case w.e.f. 30.10.2021. It is further submitted that amount of fine may be refunded as the applicant had informed the learned trial court about confinement of the accused.

 

            Learned DPG, conceded and raised no objection to the grant of criminal revision application.

 

            In the view of submissions made by learned counsel for the applicant and no objection extended by learned DPG, and the case diaries dated 30.10.2021 and 15.11.2023 placed by learned Counsel for the applicant showing confinement of the accused Makhno alias Muhammad Ameen, this revision is allowed and order dated 27.10.2023 is set-aside. Learned District and Sessions Judge, Shikarpur is directed to get the amount Rs.50,000/- refund/ return deposited in the government treasury vide order dated 27.10.2023, by learned III-Additional Sessions Judge, Shikarpur and return the same to the applicant/ surety in accordance with law.
