Through this Petition petitioner seeks Letters of Administration in his right as well as in the right of other legal heirs in respect of the estate left by their deceased father Abdul Hai Khan. All the legal heirs have filed their affidavits of no objection for the grant of instant application in favour of the petitioner. They are present in Court and affirmed the contents of their affidavits except Mrs.Zakira Bi, who stated to be unwell. However, his affidavit is on record and Mr. Nishat Warsi states that he has personally identified the lady, who is presently on bed rest is being operated in Liaquat National Hospital on 29.01.2010. Witnesses present in Court affirmed the contents of their affidavits and state that besides persons named in the memo of petition deceased had no other legal heirs.
The petition was duly advertised in the newspapers Daily Jang dated 10.12.2009. Notices were also issued through registered post, courier and pasted on the Court Notice Board. Despite no objection till-date has been filed.
In the circumstances, there appears to be no impediment in allowing this petition. The petition is allowed. Let Letters of Administration be issued in favour of the Petitioner in accordance with rules.
