Syed Azhar Abbas son of Syed Akhtar
Abbas, through his wife Farwa Hassan, seeks protective-cum-transitory bail in FIR No.203/2022, registered at P.S. FIA,
AHT Circle, Karachi under section 22(b), Emigration Ordinance, 1979 read with
sections 3 and 4 of the Anti-Money Laundering Act, 2010. Learned counsel for
applicant submits that applicant is innocent and he has falsely implicated in
this case; that applicant was unaware about registration of FIR and recently he
came to know about the instant case and being a law abiding citizen he intends
to appear before concerned Court but he apprehends his arrest as he has been
declared proclaimed offender; that at present applicant is at Bahrain and intends
to come to Pakistan on 17.03.2025. Air ticket is available at Page 29. He
further submits that since the applicant has been declared proclaimed offender
as such his CNIC and Passport have been blocked.
Be that as it may, without touching the merits of the
case, protective-cum-transitory bail
for a period of five days (from
16.03.2025 to 20.03.2025) is granted
to the applicant above named, subject to furnishing solvent surety in the sum
of Rs.25,000/- (Rupees Fifty Hundred Thousand) and P.R bond in the like amount
to the satisfaction of the Nazir of this Court. Applicant is directed to
surrender before the trial Court concerned in the aforesaid period and join the
investigation/trial forthwith. This order shall cease to have its effect after
expiry of five days from 16.03.2025 to 20.03.2025 or whenever applicant surrenders
before the trial Court, which one occurs earlier. It is made clear, in case,
applicant fails to surrender before the trial Court in the aforesaid period, his
bail bond shall stands automatically forfeited. In the meanwhile, Ministry of
Interior, Government of Pakistan is directed to unblock CNIC and Passport of
applicant for the aforesaid period. Let the copy of this order be sent to the
Secretary, Ministry of Interior, Government of Pakistan, by fax for compliance.
The instant
criminal bail application is accordingly disposed
of.
