Along with urgent application, application for return of surety is moved by applicant/surety. It appears that applicant Habib-ur-Rehman son of Muhammad Younus was admitted to interim pre-arrest bail by this Court vide order dated 04.12.2023, subject to furnishing solvent surety in the sum of Rs.100,000/- and P.R. bond in the like amount to the satisfaction of the Nazir of this Court. As per endorsement of Nazir, one Samiullah son of Abdul Qudoos furnished surety for applicant and deposited cash Rs.100,000/-.

Counsel for applicant/surety submits that after grant of bail, applicant above named faced trial and was convicted by learned trial Court vide judgment dated 26.02.2025 and presently he is behind the bar, as such, surety furnished is no more required, the same may be ordered to be returned the applicant/surety. Learned Additional P.G. present in Court in some other cases waives notice and after having gone through the case file and aforesaid judgment of the trial Court has recorded no objection for return of surety.

In the view of above, surety is no more required. Application for return of surety is allowed. Office is directed to return the surety to the applicant/surety upon proper verification and identification, as per rules.
