Muhammad Falak Sher Khan
son of Sher Muhammad Khan, was admitted to interim
pre-arrest bail by this Court vide order dated 24.01.2025, subject to his
furnishing solvent surety in the sum of Rs.100,000/-
and P.R. Bond in the like amount to the satisfaction of Nazir of this Court
and, as per Nazir’s endorsement, one Shaheen Begum wife Shair Muhammad
Khan furnished surety for applicant/accused. On 13.02.2025, surety, who is
mother of applicant, along with urgent applicant moved application for change
of surety, which was allowed and the surety furnished earlier was substituted
by way of depositing defence savings certificates of
Rs.100,000/-. On 17.02.2025, applicant/accused was called absent, however, mother
of applicant appeared and filed application for condonatin
of his absence on the ground that her son Muhammad Falak
Sher Khan is missing and the absence of applicant/accused
was condoned for the said date. Today, the position is same, neither the
applicant/accused is in attendance nor his counsel, therefore, interim
pre-arrest bail granted to applicant/accused by this Court vide order dated
24.01.2025 is hereby recalled and the instant criminal bail application is dismissed for non-prosecution.
