Applicant/accused
Muhammad Hamid son of Munshi Khan seeks
protective bail in FIR No.98/2016, registered at P.S. Shah Faisal Colony,
Karachi for offence under Sections 214, 218, 302, 109, 34, PPC. Learned counsel
for applicant submits that applicant was unaware about registration of
aforesaid FIR and he has not intentionally absconded and now he intends to
surrender before the learned trial Court concerned, but he apprehends his
arrest as the concerned police is bent upon to arrest him in order to humiliate
and disgrace him, therefore, he needs some protection to enable him to appear
before trial Court concerned.
Without touching the merits of the case, protective bail is granted to
applicant/accused Muhammad Hamid son
of Munshi Khan, for a period of four (4) days from today, subject to furnishing solvent surety in
the sum of Rs.50,000/- (Rupees fifty thousand) and P.R bond
in the like amount to the satisfaction of the Nazir of this Court.
Applicant/accused is directed to surrender before the trial Court concerned in
the aforesaid period and join the investigation/trial forthwith. This order
shall cease to have its effect after expiry of four days from today or whenever
applicant/accused surrenders before the trial Court, which one occurs earlier.
It is made clear, in case, applicant/accused fails to surrender before the
trial Court in the aforesaid period, his bail bond shall stands automatically
forfeited.
The instant
criminal bail application is accordingly disposed
of.
