            Applicants Muhammad Sohail and Khurram Saleem seek pre-arrest bail in FIR No.309/2024, registered at P.S. Bahadurabad, Karachi for offence under sections 420, 408, 34, PPC, after rejection of their bail plea by learned Additional Sessions Judge-VI, Karachi East, vide order dated 06.12.2024.

 

2.         Brief facts of the case are that Syed Azeemuddin Haider, Muhammad Sohail, Zubair Khan and Khurram Saleem, while serving in Jamiat Punjabi Sodagran Dehli Trust in Accounts Department have misappropriated Rs.96,42,554/- from February 2021 to February 2024. Upon inquiry by the department, while accepting their guilt they provided details of misappropriated funds and promised to return the said amount but later refused and absconded, hence the subject FIR.

 

3.         Learned counsel for applicants submits that applicants Muhammad Sohail and Khurram Saleem voluntarily handed over Rs.55,02,530/- out of Rs.96,42,554/- as their share and still an amount of Rs.41,40,024/- is recoverable from absconders Azeemuddin and Zubair Khan; that case has been challaned and applicants are no more required for investigation, they are facing trial and did not misuse the concession of bail.

 

4.         Complainant present in Court has recorded no objection for confirmation of bail plea of applicants/accused. Learned Additional Prosecutor General Sindh has also recorded no objection for confirmation of their pre-arrest bail.

 

5.         Since the complainant admits that applicants/accused Muhammad Sohail and Khurram Saleem have deposited their share of embezzlement amount Rs.55,02,530/- and remaining amount is yet to be recovered from absconders. In view of such position, and when the case has been challenged, applicants are regularly attending the trial Court and did not misuse the concession of bail, interim pre-arrest bail granted to applicants/accused Muhammad Sohail and Khurram Saleem by this Court vide order dated 11.12.2024 is hereby confirmed on the same terms and conditions.

 

6.         Instant criminal bail application stands disposed of in the above terms.
